“Seller” means OBGCO Ltd
“Buyer” means the person or Company who buys or agrees to buy the goods from the Seller.
“Conditions” means the Terms and Conditions of sale set out in this document.
“Delivery Date” means the date specified by the seller when the goods are to be delivered.
“Goods” means the articles, which the Buyer agrees to buy from the Seller.
“Price” means the price for the goods including VAT.

This Website and printed pages may be viewed solely for the personal, non-commercial use of the Buyer. Any downloading or copying from this Website is strictly prohibited and will be deemed an infringement of copyright.
PEAK is a registered trademark the Buyer is not permitted to use the trademark without the prior written consent of the Seller.

These Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer to the exclusion of all other terms and conditions including any terms and conditions which the Buyer may purport to apply under any purchase order confirmation of order or similar document.
All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these conditions.
Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these conditions.
Any variation to these Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless in writing by the Seller.

Orders are placed via our Website, payment may be made using the following credit/debit cards: Mastercard, Visa, Maestro, Visa Debit/Delta/Electron or American Express & PayPal. All pricing is quoted in £ sterling, inclusive of VAT at the current rate. The price shall be the price as quoted on the Website.
A contract between the Buyer and Seller will only exist once an order has been accepted and processed (at which time the Buyers credit/debit card will be charged for the value of goods ordered including postage and packing).
Upon placing an order to purchase Goods from one of the OBGCO Ltd' websites the Buyer will be sent an e-mail confirmation containing the details of the order. This e-mail will act as confirmation that the Seller has received payment in full for the Goods ordered and will be deemed as confirmation that a contract between the Seller and Buyer has been entered into (whether or not the Buyer receives that e-mail). The Buyer must check the details on this e-mail confirmation are correct at the time of receipt and print a copy.
The Buyer undertakes to ensure that all details provided are correct and that the credit/debit card used for payment is the personal property of the Buyer and that there are sufficient funds available to cover the cost of the Goods ordered.
The Seller uses the UK’s number 1 major credit/debit card merchant company SAGE PAY all payments are secured using the latest in encryption standards and follow all rules as published by our bank NATWEST. None of your card details will be held on our system for security reasons and only used via SAGE PAY to charge payment on our behalf.
Prices and availability of Goods are subject to change without notice although every effort is made to ensure this does not happen.
The Seller reserves the right to decline an order for any reason whatsoever.
If Goods are advertised at the incorrect price the Seller is under no obligation to supply the Goods at the incorrect price.

The quantity and description of the Goods shall be as set out on the Website.
While ever effort is made to describe Goods accurately, we cannot be responsible for any slight variations in colour, which may occur from time to time.

In all cases the Seller shall not be bound to deliver the Goods until the Buyer has paid for them by way of Credit/Debit Card, PayPal, Cheque or Bacs.
By placing an order the Buyer allows the Seller to use the personal details of the Buyer for the purpose of supplying the goods (including passing these details onto the relevant Courier). 
The Goods will be dispatched from stock within 1/2 working days of order placement. In the event that the Goods are out of stock or dispatch is delayed the Buyer will be notified by e-mail.
Delivery of the Goods will only be made to the cardholder’s address (and not to third party addresses). The Buyer shall make all arrangements to take delivery of the Goods whenever they are tendered for delivery.
The Seller shall not be liable for any loss or damage whatever due to failure by the Seller to deliver the Goods (or any of them) promptly or at all.

The Buyer shall be deemed to have accepted Goods on delivery. After acceptance of the Goods the Buyer shall be entitled to return Goods within 14 days of receipt for a refund with the exception of items which have been customized. If the Goods delivered are damaged defective or incorrect Customer Services must be notified by email within 24 hours quoting the invoice number.

The Seller warrants that the Goods will at the time of delivery correspond to the description given by the Seller. All other warranties conditions or terms relating to fitness for the purpose merchantability or condition of the Goods and whether implied by the statute or common law or otherwise are excluded.
The Seller shall be under no liability whatever to the Buyer for any indirect loss and/or expense (including loss of profit) suffered by the Buyer arising out of a breach by the Seller of this Contract.

The Buyer has the statutory right to cancel the Contract within 14 working days from receipt of Goods under condition Customer Services is notified in advance by email, the invoice number must be quoted in all correspondence.
In the event that the Buyer has taken delivery of the Goods before cancelling the Contract the Buyer must return the Goods to the registered office above at the Buyers own cost and risk. 
In the event that the return is approved the Buyer will be issued with a return reference number. 
We recommend you post any returns to us using a carrier who can provide a "Certificate of Posting" as, until the parcel reaches us, it is the responsibility of the Buyer. Return postage will not be refunded.

The value of the Goods will be re-credited within 28 days PROVIDED THAT the Goods are returned to the Seller in the same condition of sale.
The Seller reserves the right to deduct any carriage charges from the amount to be re-credited in the event that the Buyer does not return the Goods at their own cost.
In the event of non-delivery resulting in the return of Goods to the Seller, the Seller reserves the right to deduct any carriage charges from the amount to be re-credited to the Buyer.
Refunds will only be issued on approved returns with a valid returns reference.

If the Goods delivered are damaged defective or incorrect Customer Services must be notified by email within 24 hours quoting the invoice number. 
If the Goods delivered are damaged, defective or incorrect it is the Sellers obligation to:
Replace Goods which are damaged or defective; or
Refund the value of the Goods in question.

The Goods shall be at the Buyer’s risk as from delivery.

The Website Terms and Conditions and Contract of sale shall in all respects be construed and operate as an English Contract and in conformity with English Law. The headings hereto shall not affect the construction hereof.
